Jesse has defended various private and public entities against cost recovery, citizen suits and enforcement actions at sites throughout the country, including numerous federal and state Superfund sites. As part of his Superfund practice, he represents both individual clients and joint defense groups at a wide range of facilities, including mixed-use landfills and other industrial operations, including airports, industrial ports, former drum recycling, chemical manufacturing and wood treatment facilities. Additionally, Jesse has pursued CERCLA, RCRA, CWA and common law claims through litigation and in mediations, obtaining substantial funds for clients’ environmental cleanup work. Jesse has broad experience working with experts in the technical aspects of litigation, including contaminant fate and transport, identification of potentially responsible parties, and the range of factors affecting multiparty cost allocation. Jesse’s extensive experience in the environmental area makes him particularly adept at extracting key information through the discovery process.
In addition to his CERCLA and RCRA experience, Jesse’s practice also focuses on Clean Water Act, Clean Air Act, insurance coverage and common law contamination claims, as well as a large amount of surface and ground water-related matters. As part of his regulatory enforcement experience, Jesse has negotiated settlement terms with the California Attorney General’s office, the EPA, and other state and federal agencies. Jesse has extensive experience appearing in both federal and state courts and was a lead lawyer on the U.S. v. Eastern Municipal Water District et al case, which culminated in one of the top defense verdicts of 2009.
