Steve Brody brings his considerable leadership and organizational skills to multiparty, multijurisdictional proceedings.

He represents the largest and most well-known global financial services companies in a broad array of commercial disputes, including securities and other commercial matters. Steve also is an established authority on constitutional and advertising law, including First Amendment and Commerce Clause matters, and he represents leading consumer products companies. Before joining Bingham, Steve was the New York litigation practice group leader for both legacy McKee Nelson and King & Spalding.


  • Auditing the procedures employed by outside foreclosure counsel for a mortgage loan servicer in numerous states
  • Representing an alleged sub-feeder in connection with investments in a Madoff-related fund
  • Representing an indenture trustee in claims alleging impermissible “waterfall” distributions
  • Representing a global investment bank in a multibillion-dollar litigation involving the fraud of an ABS issuer
  • Counseling syndication agent in a securitization with respect to agent fees
  • Representing underwriter in MF Global class action litigation
  • Representing a commercial bank in securities litigation relating to the bankruptcy of Adelphia Communications Corporation and, separately, the IPO of Vonage Communications
  • Conducted a self-assessment for an investment bank as required by regulators
  • Representing nonoperating leaseholders in multidistrict litigation arising out of the Deepwater Horizon oil spill in the Gulf of Mexico
  • Represented an investment bank in a dispute concerning insurance coverage for defaulted loans
  • Represented a generic drug company in a Lanham Act case concerning false and misleading advertising for an over-the-counter drug
  • Represented nine trade associations in a lawsuit challenging the city of Los Angeles’ restrictions on alcohol beverage advertising
  • Submitting amicus briefs concerning advertising issues on behalf of various entities to the U.S. Supreme Court and other federal and state appellate courts
