John F. Adkins

Of Counsel

John Adkins represents clients in labor and employment law matters. He is past chair of the Labor and Employment Group, the Litigation Training Committee, and the National Pro Bono Committee. Before joining Bingham, Dana & Gould in 1972, he served in the U.S. Marine Corps as a defense lawyer, prosecutor, military judge and instructor at the Naval Justice School.

John regularly appears before state and federal agencies and courts throughout the New England region. He is principal author of Massachusetts Practice Series, Vol. 45, Employment Law, 2nd Ed. (Thomson/West 2003) and co-editor of Massachusetts Employment Law (MCLE 2011). John is also a management member of the Labor and Employment Law Section of the American Bar Association, Labor Law Council of the Massachusetts Bar Association, Labor and Employment Law Section of the Boston Bar Association, and the Litigation Curriculum Advisory Committee of Massachusetts Continuing Legal Education Inc. He was a founding member of the Governor’s Advisory Board to the Massachusetts Commission Against Discrimination and is a frequent lecturer on employment law matters.

Experience

  • Managed significant reductions-in-force in transportation, software and securities industries
  • Developed executive performance reviews for more than 120 positions and trained executive managers in their implementation for major transportation industry client
  • Consulted in reorganization of national insurance legal department, including creating an effective management structure for multifaceted legal operations, pre-empting various discrimination charges that could result from particular personnel actions and dealing with potential harassment charges
  • Successfully represented numerous clients in investigating internal discrimination or harassment charges and in defending against charges before state agencies and in court
  • Counseled numerous clients nationwide on federal and state wage-and-hour issues, including exempt status, payment of wages, severance pay and child labor issues
  • Conducted labor and employment due diligence for acquisitions in agricultural, finance, software, energy, marketing and chemical industries nationwide
  • Represented national hospitality, construction and chemical industry clients before various regional offices of the National Labor Relations Board in prosecuting secondary boycott charges against unions and defending against discrimination charges
  • Represented clients in healthcare, transportation and securities industries in labor and employment arbitrations
  • Developed affirmative action plans and counseled clients on E.O. 11, 246 compliance in insurance, medical supplies, software, environmental and legal industries
  • Represented numerous clients in negotiating and enforcing employment agreements, including confidentiality and non-compete agreements, in arbitration and court in textile, real estate, investment, printing and professional sports industries nationwide
  • Represented hospitality clients in licensing matters before the Massachusetts Alcoholic Beverage Control Commission
