Susan Baker Manning is a litigator who focuses her practice on intellectual property matters, including patent, trademark and copyright cases.

Susan appears regularly before both federal district courts and courts of appeal, as well as government agencies such as the International Trade Commission. She has extensive experience in all phases of litigation at both the trial and appellate levels. She has worked extensively with technology companies to protect their intellectual properties, obtaining injunctions and damages on behalf of her clients.

In addition to representing name-brand technology companies, Susan devotes a portion of her practice to assisting those in need. Her pro bono victories include successful representation of a domestic violence shelter, numerous civil rights cases, and asylum matters on behalf of those fleeing violence and oppression. She currently represents several ethnic Uighurs falsely imprisoned at Guantánamo Bay, Cuba, despite military acknowledgements of their innocence.

REPRESENTATIVE MATTERS
  • Ground Fault Circuit Interrupters and Products Containing Same, Inv. No. 337-TA-615 (U.S. International Trade Comm’n) — Trial counsel to a manufacturer and several distributors in a recent ITC investigation initiated by Pass & Seymour, alleging infringement of several patents on ground fault circuit interrupters
  • Sucralose, Sweeteners Containing Sucralose, and Related Intermediate Compounds Thereof, Inv. No. 337-TA-604 — Representing six different respondents, including two manufacturers in China, in a case brought by Tate & Lyle alleging infringement of process patents relating to the production of sucralose and certain intermediate compounds; in September 2008, the ALI issued an initial determination finding no violation by our clients based on non-infringement and other grounds; on April 4, 2009, after a full review of the decision, the Commission upheld the ALJ’s findings there was no violation of Section 337, resulting in a  complete victory for our clients

  • Ingenio, Filiale De Loto-Quebec, Inc. v. GameLogic, Inc., Case No. 04-1532 KAJ (District of Delaware) — Defend start-up manufacturer of gaming products in patent infringement action involving company-critical technology
  • Command Audio Corp. v. Sony Electronics, Inc., Case No. C-02-0599 MJJ (Northern District of California) — Prosecute patent infringement action involving on-demand audio against major electronics manufacturer
  • Ciena Corp. v. Nortel Networks, Inc., Case No. 2:05-CV-14 (Eastern District of Texas) — Prosecute and defend patent infringement action involving 23 patents in optical networking and asynchronous transfer mode (ATM) networking technologies
  • Foundry Networks, Inc. v. Nortel Networks, Inc., Case No. 02-04909 CRB (Northern District of California) — Prosecute and defend a patent infringement action involving seven patents in Voice Over IP and asynchronous transfer mode networking technologies

  • Intouch Group, Inc. v. Amazon.com, Inc.  Case No. 00-1156 DLJ (Northern District of California)— Defend leading internet retailer against claims of patent infringement involving thirty-second sound clips; case settled after succeeded in invalidating majority of patent claims on summary judgment
